Insurers Lose Human Rights Challenge To $1B Oil Spill Suit

Insurers Fight Referral Of $1B Oil Spill Liability Suit To ECJ
Law360, London (December 17, 2020, 7:13 PM GMT) A club of insurers fighting the recognition of a Spanish ruling that found it liable for up to €855 million ($1 billion) in damages stemming from a devastating 2002 oil spill urged a London judge Thursday to dismiss Spain s bid to have the case referred to the EU courts.
Christopher Hancock QC, counsel for London Steam-Ship Owners Mutual Insurance Association Ltd., said that Spain requested the referral at the eleventh hour with no formal application, and that sending the case to the ECJ would be unnecessary and a waste of money.
