New York state recently passed long-awaited adult-use cannabis legislation, taking the lead on other key jurisdictions with medical use-only systems, such as Florida and Pennsylvania. While the bill awaits implementation, now is the time for entities interested in entering the market to gear up for the application process. While new businesses aren’t expected to open for at least a year, the regulations will be published and license process initiated much sooner. Over the next few weeks, Fox Rothschild’s national Cannabis Law team, led by our New York group, will provide in-depth insight into various aspects of the new law, covering a full range of issues, including social equity, real estate and labor provisions.
Laws in 20 states prohibit employers from discriminating against workers because of their medical pot use. But as evidenced by McCarty s case, there are no explicit workplace protections for medical marijuana users in Florida. Instead, the state statute on medical pot upholds an employer s right to enforce a drug-free workplace and doesn t require companies to accommodate workers medical marijuana use.
Two bills introduced in the Florida Legislature would have changed that, but both failed. The first, introduced in 2019 by state Rep. Tina Polsky of Boca Raton, would have barred employers from discriminating against, firing, demoting, or taking any other adverse personnel action against any employee who is a card-carrying pot user. The bill included exceptions for people performing safety-sensitive job duties, such as operating machinery, fighting fires, driving, handling hazardous materials, carrying a firearm, or caring for children and patients.

Effective March 31, 2021, adults aged 21 or older can lawfully possess, use, and transfer (without compensation) up to three ounces of cannabis and up to 24 grams of concentrated cannabis. Eligible adults are also able to cultivate up to three mature and up to three immature cannabis plants.
