PUTRAJAYA: The Court of Appeal was told that Datuk Seri Najib Razak had abused his position when he sat in Cabinet meetings to approve two government guarantees for loans amounting to RM4bil for SRC International Sdn Bhd, a company he had a personal interest in.
Ad hoc prosecutor Datuk V. Sithambaram said in his submissions at the hearing of an appeal filed by Najib that the offence under Section 23 of the Malaysian Anti-Corruption Commission Act, which the former prime minister was convicted with, did not depend on the receipt of the gratification but the use of position in obtaining the gratification.
PUTRAJAYA (Bernama): The Court of Appeal heard on Wednesday (April 14) that Datuk Seri Najib Tun Razak did not travel to Switzerland to bring back the funds belonging to SRC International Sdn Bhd that were frozen by the Swiss government for money laundering.
PUTRAJAYA: Datuk Seri Najib Razak had failed to protect pensioners funds when a RM4bil loan from the Retirement Fund Inc (KWAP) was given to SRC International Sdn Bhd, a company he is said to have a personal interest in, the Court of Appeal heard.
Ad hoc prosecutor Datuk V. Sithambaram told the three-man bench that SRC International, a subsidiary of troubled sovereign wealth fund 1Malaysia Development Bhd (1MDB), was established with the support of Najib.
He said this during submissions at the appeal hearing for Najib against his conviction and sentence in the SRC International case here on Wednesday (April 14).

In fact, ad-hoc prosecutor Datuk V Sithambaram (pix, left) said the former premier did not even resolve the matter until he left office.
“The appellant (Najib) did not travel to Switzerland to repatriate the funds back to Malaysia. My Lord, I did not expect this from him as he was the prime minister and finance minister at the material time.
