Gov. Kevin Stitt has filed a lawsuit against the Biden administration over the state s right to regulate mining in eastern Oklahoma.The lawsuit is the newest chapter in the legal battle over tribal sovereignty after the U.S. Supreme Court s McGirt ruling. Stitt has been very clear recently that he wants to completely overturn the McGirt decision, which led to courts finding that the Five Tribes of Oklahoma still have reservations today. The court said the ruling means the state can t prosecute many crimes in tribal areas, but the question is: Does that apply to other things the state does in those areas?Oklahoma has a program to regulate surface coal mining and reclamation.
