Italian Marines case: Cough up Rs 10 crore compensation from Italy
Taking a tough stand, the Court told the centre to deposit the Rs 10 crore Italy had paid it as compensation for the 2012 shooting incident in which two Indian fishermen were killed.
In an unprecedented move, the
Supreme Court said that the criminal case against two Italian marines who killed two Indian fishermen off the coast of Kerala in 2012 would not be closed until the compensation was deposited and disbursed to the victims.
The Court directed the centre to deposit the compensation amount of Rs 10 crore to it. This is the amount Italy has paid to compensate the families of the deceased and injured fishermen. A three-judge bench headed by Chief Justice SA Bobde, and Justices AS Bopanna and V Ramasubramanian was hearing the case.
NEW DELHI: The Supreme Court on Friday directed the Centre to deposit in its account the compensation given by Italy for the kin of two Indian fishermen killed by Italian Marines off the Kerala coast in February 2012.
A bench of Chief Justice SA Bobde and Justices AS Bopanna and V Ramasubramanian said the top court will disburse the compensation to the kin of the fishermen killed.
It said that after one week of deposit of compensation amount in its account, the top court will hear Centre s plea for closure of the case against the Italian Marines.
The apex court listed the application for closure of criminal trial against Italian Marines on April 19.

The Supreme Court on Friday observed that the criminal cases pending in India against the two Italian Marines in the Enrica Lexie case will be closed only after the Republic of Italy deposits the compensation agreed to be paid to the victims of sea firing incident of 2012.
A bench headed by the
Chief Justice of India SA Bobde directed that the Republic of Italy should deposit the compensation amount in terms of the award of the international tribunal in the account specified by the Ministry of External Affairs. Within a week of receiving such amount from the Italy Government, the Ministry should deposit the same before the Supreme Court, the bench further ordered.

The Supreme Court on Friday asked the Centre to deposit with it the Rs 10 crore compensation agreed to be paid by Italy to the families of the two Indian fishermen killed by Italian marines off Kerala coast in 2012. We will ask for the amount to be deposited in this court. Only then we will close the proceedings, a Bench led by Chief Justice SA Bobde told Solicitor General Tushar Mehta.
The CJI said the top court would disburse the compensation money to the kin of the deceased fishermen. Republic of Italy states an amount of compensation in terms of award passed in 2020 will be paid by Italy to India in the particular account specified by MEA. We direct that after such transfer the said amount be deposited in Supreme Court within one week thereafter, it said, posting the Centre s plea for closing the case on April 19.
