THE Office of the Attorney General has charged 17-year-old Kenneth Thomas Blas Kaipat with sexual assault and other offenses in adult court following the Superior Courtâs order granting the criminal divisionâs request to transfer the case from juvenile court to adult court.
Kaipat was arrested on Friday. He was charged with three counts of sexual assault in the first degree, two counts of sexual assault in the second degree, aggravated assault and battery, assault with a dangerous weapon, strangulation, and burglary. His bail was set at $250,000.
At the initial hearing before Associate Judge Joseph N. Camacho on Monday, Kaipat appeared in the custody of the Department of Corrections and was represented by attorney Brien Sers San Nicolas who argued for a bail reduction and modification.
SUPERIOR Court Associate Judge Joseph N. Camacho on Tuesday appointed a mental health expert, Dr. Andrea M.S. Leitheiser, to conduct an examination on Lucas Taitano Manglona and Queena Ogumoro Fitial, and to report on their mental health condition in the next 30 days.
After Dr. Leitheiser has filed her report, Judge Camacho said he will schedule a competency hearing.
The judge also suspended all court proceedings in the criminal prosecution of Manglona and Fitial who were charged separately.
Manglona and Fitial, through their respective counsels, recently asked the court to dismiss the charges against the defendants for the violation of their rights to due process and speedy trial.
SUPERIOR Court Associate Judge Joseph N. Camacho denied a petition for partial distribution of financial assets, including the transfer of funds from the Estate of Antonia Camacho Sablan to the Estate of Manuel M. Sablan.
Judge Camacho on Monday said the amount ($93,524.83) constituting the family inheritance of Antonia C. Sablan from her father Juan Naog Camacho âshall pass as if Antonia C. Sablan had died intestate (without a will), in equal shares, to each of their nine children.â
These are the facts of the case:
1) Juan Naog Camacho (âJuanâ), the father of Antonia Camacho Sablan, died intestate on Sept. 2, 1970.
2) Antonia Camacho Sablan (âAntoniaâ) married Manuel Magofna Sablan (âManuelâ).
