First civil trial in St Clair since Covid involves Syngenta s paraquat; Plaintiff attorney was big contributor to presiding judge s 18 campaign | Madison

Hoerner BELLEVILLE – Associate Judge Kevin Hoerner plans to hold St. Clair County’s first civil jury trial in a year for six clients of Stephen Tillery, who contributed $11,100 to Hoerner’s campaign for appellate judge in 2018.  Hoerner has set proceedings to begin April 12, on Tillery’s claim that weed killer paraquat causes Parkinson’s disease.  Five of his six plaintiffs don’t live in St. Clair County.  Tillery sued Syngenta, Growmark, and Chevron for 11 plaintiffs in 2017.  Chief Judge Andrew Gleeson assigned the suit to former judge Vincent Lopinot.  Gleeson stood for retention in 2018, and Tillery gave his campaign $10,000.  In December 2018, Lopinot retired and Gleeson assigned himself to the suit. 

St Clair County Circuit Court to begin limited reopening March 1

Gleeson St. Clair County Chief Judge Andrew Gleeson announced Monday that the circuit court will begin limited reopening on March 1.  “Considering the decline in the COVID-19 positivity rates in St. Clair County and the successful implementation of the dissemination of the vaccine, the courts in St. Clair County are reopening on a limited basis on Monday, March 1, 2021,” the press release states.  Court personnel, the judiciary and the general public will still be required to adhere to guidelines put in place by the Centers for Disease Control “in order to ensure the safety of the general public.” Those requirements include wearing masks and social distancing. 

Rosenstengel allows dent repair dispute plaintiff to amend complaint; Finds Gleeson properly corrected lawsuit dating error

Cronin EAST ST. LOUIS – Chief Twentieth Circuit Judge Andrew Gleeson properly corrected an inadvertent dating error that involved a statute of limitations, Chief U.S. District Judge Nancy Rosenstengel decided on Jan. 15.  She found that dent repairman Wesley Huff filed suit in a business dispute last March 30, not on April 7 as a stamp on the complaint showed.  Gleeson entered an order changing the date last June.  Rosenstengel wrote that if there is proper evidence of a clerical error, a judge may correct it at any time.  Nothing but the date remained on the complaint when she finished with it.  She dismissed all counts against Huff’s former partners Charles Binkley, Eric Stokes and Andy Clawson, and she gave Huff three weeks to amend the complaint.
