THE Commonwealth Utilities Corp. board on Wednesday approved the CUC-Public School System net metering policy memorandum of agreement.
Following the approval of the MOA, CUC legal counsel Jose Mafnas Jr. said PSS can avail itself of net metering benefits.
But he said there is a legal issue between CUC and PSS regarding  the interpretation of some of the language of Public Law 18-75, which allows CUC to establish a net metering agreement with public health and education entities.
Mafnas said that the CUC board ârecognized the need for this MOA, so that PSS can install its solar panel system.â
He said the agreement will also allow the parties to amend the MOA if needed pursuant to the opinion of Attorney General Edward Manibusan.
THEÂ administration has yet to remit over $4.7 million to the Public School System, PSS Finance Director Arlene Lizama said during a recent Board of Education meeting.

In related news, U.S. Congressman Gregorio Kilili Camacho Sablan said he has introduced three bills in the U.S. House of Representatives that would provide more federal funding to CNMI education.
On Thursday, Lizama told the BOE that the CNMIÂ government was supposed to have transferred to PSS a total of $8 million by Jan. 27 based on the fiscal year 2021 budget or Public Law 21-35.
