IP rights constitute an important target in any entrepreneurial activity. Although the journey of an entrepreneur – from laying down the first ideas to putting them into practice – is often extremely complex and firmly anchored in the financial and administrative sides of the business, one of the central aspects at the beginning of any such project is represented by the selection, protection and careful management and defence of IP assets.
Given that practice has shown that neglecting these aspects sometimes leads to dramatic situations that can significantly affect a business, it is advisable that businesses prioritise the registration of their IP rights.
The Bucharest Court recently ruled in a case in which a Romanian company, M Car Trading SRL, contested a State Office for Inventions and Trademarks decision that favoured BMW. The decision provides insight into the court's practice in assessing the reputation of earlier trademarks when invoked as relative grounds against subsequent trademark applications and underlines the importance of documenting and providing sufficient evidence to support a claim of reputation.
Various amendments to the Trademarks Law recently took effect, transposing the provisions of the EU Trademarks Directive. It is hoped that such changes will facilitate a better harmonisation of Romania's legal provisions and the procedures applied by the IP office in connection with the registration and protection of trademarks. The Romanian Foresters Association (ASFOR) has registered at the State Office for Inventions and Trademarks (OSIM) the Romanian Wood trademark, which aims to capitalize on wood products from Romania, only from sustainable-managed forests, operated by Romanian companies and capitalized on transparently.
According to the information of the association, posted on its own Facebook page, the documents for the trademark registration at OSIM were submitted last year, on May 5.
