LUMPUR: The High Court today was told that it is incorrect for the prosecution to say that former prime minister Datuk Seri Najib Tun Razak (
pix) had direct control over 1Malaysia Development Berhad (1MDB) for the latter to exercise his power which allegedly caused the money from the sovereign wealth fund to flow into his personal bank accounts.
Lawyer Tania Scivetti representing Najib said based on the affidavits of Senior Assistant Commissioner R. Rajagopal and Superintendent Foo Wei Min regarding the alleged money trail involving funds going out of 1MDB into the Pekan MP account, there was no documentary evidence that the money flowed into his account due to his (Najib) instruction.

PUTRAJAYA, April 12 Datuk Seri Najib Razak did not dishonestly misappropriate RM42 million from SRC International Sdn Bhd since he did not know of the fund’s source and subsequent utilisation of it does not prove the element of dishonesty under criminal breach of trust (CBT), the Court of Appeal heard today.
Najib’s lawyer Harvinderjit Singh said this during submission in Najib’s appeal hearing against the former prime minister’s conviction and jail sentence for misappropriation of RM42 million SRC International funds.

PUTRAJAYA: The testimony of a former chief executive officer of Yayasan Rakyat 1Malaysia (YR1M) that Datuk Seri Najib Tun Razak’s then principal private secretary had asked to coordinate the transfer of RM42 million into the former premier’s bank account was hearsay and inadmissible, the Court of Appeal heard today.
The former premier’s counsel, Harvinderjit Singh, in his submission, said Ung Su Ling’s testimony was disputed as her September 2014 meeting with the late Datuk Azlin Alias (Najib’s former principal private secretary) and his so-called instructions were relied on as evidence in the prosecution’s case.
KUALA LUMPUR (Bernama): The High Court here on Monday (April 5) was told that a bungalow in Tanjung Bungah, Penang, owned by Puan Sri Goh Gaik Ewe, the mother of fugitive businessman, Low Taek Jho, or Jho Low, should not be a subject matter on the ongoing forfeiture suit, as it is not related to the 1Malaysia Development Berhad (1MDB) scandal.
Lawyer M. Puravalen, who is representing Goh, 69, submitted that no averments were made regarding the house, which was built on two plots of land purchased by Goh back in 1990 and 1993, based on the sale and purchase agreement produced in court today.
