The Supreme Court could make the choice but maybe not with only eight justices. If there is a question of law in play, i am sure companies will be attempting to seek further review but we dont see them likely to get it and likely unable to win we see. You view the circuit split being a large barrier to get a review . It is not a guarantee but they dont have that to look to to suggest the Supreme Court must decide some kind of split between two a
