Blair berman had a few words using his cell phone to call family and the state called First Responders and a rail expert the contention was that the defense was negligent and pushing back findings that after being distracted by a rock attack on the nearby septa train it was possible that bostian lost situational awareness. But the judge says it was more likely an accident than a crime. Brandon bostian is a good man and his heart breaks for the loss of life in this case and the tragedy that occurred but he is innocent. But the judge agreed with the defendants that what occurred was more likely an accident rather than a crime. This was an accident. The prosecutor was asked would the state refile criminal charg charges. That is up to people above me. And we did hear just a few minutes earlier from mr. Grace a spokesperson from the Attorney Generals Office and the ag office is reviewing the judges decision and look at the notes of testimony and their own prosecutal responsibilities.
