lawrence: i don t want to get in that. steve: there is separation of powers right there. that should be executive branch, not judicial. she said that s unprecedented and probably unconstitutional. ainsley: so the conditions of hunter s release. he has to actively seek employment. she said go get a job. he can t use alcohol. steve: poor guy. ainsley: he can t use elicit drugs. he has to submit to drug testing. he cannot possess a firearm. as long as he adheres to this agreement, the gun case is wiped from his record. otherwise, the felony charges carry 10 years in prison. steve: well, the interesting thing is and for people to say look, he got a sweetheart deal. they were only going after him on the gun charges. and the tax eevaporation. the u.s. attorney said the investigation into him is continuing. lawrence: ongoing. steve: they might get another bite of the apple and go after something else. ainsley: when she says go get
did that how did that change the case? i don t think it changes what she is going to do at all. unfortunately, i think she has the right to consider anything in the public record and to say i just don t think this deal is in the public interest. and i m not going to accept the plea agreement that calls for a misdemeanor. but i don t think she will do that. she sent kind of a signal early on, kind of a subtle signal that she considers that that s an executive branch issue. so i think ultimately, she is going to accept whatever whatever plea deal, whatever compromise is hammered out by the prosecution and the defense. steve: seems like even though the two sides have been working together on a deal for months, reportedly, it seems like they show up in court, they don t have they haven t kept their answer straight. one side, the prosecution says the investigation is ongoing. and the defense says no, it s
federally for much, much longer. i have never seen anything like this. they basically, both sides basically buried a key provision within the diversion, the pre-trial diversion. there is the pre-trial diversion which usually the judge has nothing to do with. there is a very broad provision in the pre-trial diversion agreement is basically what gave him, hunter biden broad immunity. and the judge figured it out and wouldn t let it happen. and, by the way, this is paragraph 15 of the pre-trial diversion agreement. she didn t even get that apparently until a few minutes before the actual plea hearing. very, very hinky. steve: no kidding. and the day before the judge received, i think, 400 pages from the house ways and means committee chairman jason smith who is going to be on our program in a little bit which included the whistleblower testimony. and we heard them live last week.
