but, joe, when you look at the evidence, at some point, you have to amalgamate it all together and say it is overwhelming and it is important to americans there be some accountability here so this can never happen ben. interesting news yesterday on that front, by the way. we learned the doj requested transcripts of all the depositions conducted by this committee, showing their interest, perhaps, in some criminal prosecution here. john eastman was right at the center of yesterday s hearing. the committee acknowledging eastman acknowledged himself there was no legal basis for his theory to overturn the election. eastman argued that vice president pence had the power to throw out the electors from disputed states and declare trump the winner under the 12th amendment. the committee reviewed an intended letter from trump for eastman in october 2020, one month before the election, in which eastman acknowledged his own argument had no standing.
while the the capital is already being occupied, president trump is tweeting that mike pence in effect betrayed his office. encouraging some of the rioters to say, them to consider, to continue. that s a big deal. that s actually a very significant piece of evidence that, you know, when you pull it all together, you say to yourself, boy, this sure does look like a crime. and incitement of insurrection itself is mentioned in the statutes. one of the oath keepers pled guilty to seditious conspiracy. that s a big deal too. they were providing protection for roger stone at the time. so the pieces are starting to come into place. and that s i think what s one legal question here, eastman, what is the difference between being wrong, which eastman could have been wrong about what the electoral count act lets people do, and being illegal? when does it go from being wrong to criminal? this is the key question
insurrection, january 5, 2021. one of our most important findings in the book is president trump called into this war room to talk to bannon and giuliani on the 5th after vice president pence left the white house. pence had resisted trump s pleas to try to move the election into the house of representatives. so you see in our book, a coordination of sorts, a communication between the white house, its own political command center and this outside command center at the willard. yeah. pretty extraordinary actually the details from the book, but let s turn to what was happening during the attack. your paper reported an an email exchange between john eastman and an aide in which eastman wrote, quote, the siege is because you and your boss did not do what was necessary. to allow this to be aired in a public way so that the american people can see for themselves what happened and that s referring to trump s claims of voter fraud, and again, this was happening during the siege. i find it so
5th. eastman is doing his own work and he continues to talk to pence s team, including on the 6th. i just want to confirm. he was talking during the siege, on the 6th while mike pence was potentially hearing chants of the maraders in the capitol saying, hang mike pence? that s what was going on as he was literally hiding for his life? it s not just eastman who s reacting like that. it s eastman interacting with greg jacob, pence s lawyer, being disappointed by pence s conduct. you also see president trump. trump, he s in the oval office and confronting keith kellogg. pence is in trouble at the capitol and trump keeps watching television, as almost an idle person as this insurrection unfolds, and yet trump of course, had been very aggressive in pushing pence in the days prior. just extraordinary when you explain it like that. hey, robert, stay with me for just a moment. president biden right now has
