Judge rules against developers seeking to stop North Port contraction

NORTH PORT – Circuit Court Judge Hunter W. Carroll denied a motion for a preliminary injunction against a resident push to contract the city of North Port Monday morning. In a 12-page ruling, Carroll essentially said the push by the attorneys for Wellen Park, LLLP, Mattamy Tampa Sarasota, LLC; Neal Communities of Southwest Florida, LLC; and GB WV, LLC, to stop contraction did not prove “likelihood of irreparable harm; the unavailability of an adequate remedy of law; the substantial likelihood of success on the merits; and the injunction will serve the public interest.”  Given that, Carroll later wrote in his conclusion that, while the developers’ investment of more than $370 million is substantial, the uncertainty of deannexation is an adverse impact.

NORTH PORT – Developers seeking to quash a bid by residents for the city of North Port to contract city limits and de-annex land west of the Myakka River argued that the process itself is resulting in financial harm that cannot be fixed even if the city of North Port ultimately decides to keep its borders intact. That’s essentially the gist of the latest statement filed Jan. 15 by attorney David Smolker on behalf of Wellen Park LLLP, Mattamy Tampa/Sarasota LLC, Neal Communities of Southwest Florida and GB WV LLC. That came in response to the closing argument filed Jan. 7 by Luke C. Lirot, attorney for West Villagers for Responsible Government.

Judge to rule in early 2021 on suit against North Port contraction bid

NORTH PORT – Wellen Park made its case Tuesday to 12th Judicial Circuit  Court Judge Hunter W. Carroll in its suit to end the contraction petition process started by residents seeking to separate themselves from the city of North Port. And while the bulk of the two-plus hour hearing was taken up by the testimony of attorney Jeff Boone – the attorney partly responsible for the land annexations in question, as well as the legislation that created the West Villages Improvement District – Carroll noted that his decision will come down to a concept in Florida law that says all contracts wrap into them all laws that existed at that time.

Residents counter developer claims in Wellen Park contraction suit

NORTH PORT – Two of the founders of the West Villagers for Responsible Government have asked the court to allow them to intervene in Wellen Park’s suit to quash an attempt to contract the city of North Port and de-annex incorporated land west of the Myakka River. Attorney Luke C. Lirot filed a motion on Dec. 10 asking Circuit Judge Hunter W. Carroll to allow John Meisel and David Fernstrum to intervene in the lawsuit. Once granted that status, Meisel, the president of the group, and Fernstrum, the registered agent when the political action committee was first formed, will file a motion for summary judgment to dismiss the case filed by Wellen Park and its associates that is seeking to either block a proposed referendum on contraction or have the city of North Port consider the matter as part of a quasi-judicial process that would include the developers as part of the process.
