Fort Collins homeless camping ban: City won t appeal ACLU lawsuit

Editor s note: This story was updated at 12:45 p.m. Thursday to include comments from Fort Collins city attorney. In a split vote, Fort Collins City Council decided against appealing a court ruling related to enforcement of the city s camping ban. Council voted 4-3 to not appeal the recent ruling, which found that Fort Collins Police Services unconstitutionally ticketed a man for sleeping in his car at a rest stop in 2018.  ACLU of Colorado assisted the man, Adam Wiemold, in his appeal of the ticket. When they emerged, three council members said they supported an appeal: Mayor Wade Troxell and council members Ross Cunniff and Susan Gutowsky. As one motivation for the appeal, Troxell cited a need for clarification on the question of voluntary vs. involuntary homelessness.

Hughes Stadium ballot language: Fort Collins won t appeal court ruling

Fort Collins City Council won t appeal a judicial ruling on the Hughes Stadium ballot measure. In a 4-3 vote at their Tuesday meeting, council members decided not to appeal the Larimer County District Court ruling that set the ballot language for the April 6 election. The ballot measure, if approved, will require the city to zone the former Hughes Stadium site as 100% open lands and attempt to purchase it from the Colorado State University System. The city requested judicial review of the part of the ballot measure that would direct Fort Collins to try to buy the land. City attorney Carrie Daggett and some council members questioned whether a directive to purchase land is an administrative matter, which is legally inadmissible in a ballot measure.

If passed, it would force the city to zone the land as open space and attempt to purchase it from the university.

Fort Collins, Colorado Mayor Wade Troxell, whose background lies in engineering, is a member of the committee made up of representatives with a wide range of expertise including tech, parcel delivery, and business leadership.   Though human innovation typically outpaces regulation, the great promise that drone technology poses cannot come second to privacy and safety, Troxell told Cheddar.
