On Friday, Judge Ratha Mokgoatlheng ruled that accused number 2, Bongani Ntanzi’s right to a fair trial was infringed upon when he was recorded without his knowledge.
The defence argued against the recording of the alleged confession from one of the accused being admitted as evidence, while the State argued that there was nothing by law from prohibiting it being used.
