It was on the minds of some of the Founding Fathers. On september 5, 1787, at the constitutional convention, they were discussing the public land related authorities in the constitution, including the authority that has now been included in whats often referred to as the enclave clause, article 1, 78 clause 17. Wufl delegates to the one of the delegates, elbridge garrett, a delegate from massachusetts stood before the convention and made an astute observation. There gary said this power, that is the power of congress over federal public lands might be made use of to enslave any particular state by buying up its territory and that the strong holds proposed would be a means of aweing the state into undue obedience into the general government. Close quote. Then as now wise observes often came from the state of massachusetts. Then as now, we have a grave risk associated with the fact that when the federal government owns this much land, the federal government has this much power and it was
The Prior Administration or this administration chose to release a prisoner. And when applied to the situation for which it was drafted, its a practical and fully constitutional provision. Its practical because it involves a 30day delay in release of a prisoner where theres no particular hurry to release the prisoner. We releaseed the prisoner 30 days after the notice, we make the decision to release the prisoner, the prisoner is released. Tanned gives congress 30 days to perhaps pass a law prohibiting such release. And i believe its constitutional because it doesnt interfere with the commander in chiefs ability to safeguard and protect the soldiers under his command. Now there is an attempt to criticize the president for not following this statute when its applied to a situation for which it was not drafted and when its applied in such a way where it becomes incredibly imprktcal, perhaps impossible impractical, perhaps impossible, and constitutionally questionable. We have had Prisone
Challenged in courts. Yields time im happy to to my good friend from the other side of the aisle, from georgia, two minutes. The gentleman from georgia. The gentleman from georgia is recognized for two minutes. Under current law, the president is required to notify Congress Prior to releasing any prisoners from Guantanamo Bay. Unfortunately, he failed to do that. Although im grateful to sergeant that Sergeant Bergdahl has been reunited with his family, i strongly disagree with the president s decision to negotiate with terrorists. I dont agree with his position to make this Prisoner Exchange without first consulting with congress and the manner required by federal law. The freeing of terrorists poses a National Security threat to americans and our armed forces and complicates its not going to change their perception one iota. I understand that people had an honest disagreement about the way the statute was interpreted and implemented. What i was just saying to you was that that is an h

Helicopter came to evacuate the wounded and a mortar round went off nearby that helicopter. The concern being that that mortar round damaged the helicopter, may have damaged the rotor blades so theyre checking its ability to fly. U. S. Military making clear that helicopter was not shot down. No one injured on board the helicopter, but prior to that there was a fire fight and one u. S. Service member was killed in that fire fight. Its a reminder, john and kate, there is still a war going on in afghanistan. There are still thousands of u. S. Troops there and they are still going on counterterror missions. Theres been a lot of talk about how their role has changed. That theyve retreated to their bases, only doing Security Force protection, but the fact is theyre doing counterterror operations as we saw today. Those operations can be dangerous and deadly. A very harsh reminder of that. Jim sciutto, thanks very much. Lets bring in cnn military analyst, general james. Thanks for joining us.
