the defendant, william porter, he is charged with very serious offenses, involuntary manslaughter, second degree assault are the two most serious. they both are ten years maximum in prison and so he could serve at least 20 years if convicted of those two alone. william porter was not there at the beginning of that van ride when freddie gray was arrested and put into the van and began to be transported. he came halfway through when the driver officer goodson radioed in he needed another officer to check on a person they were transporting. that was william port. that s when he came on. here s what prosecutors believe is so important. he said to freddie gray in that van, do you need medical attention? he was aware. he saw something. freddie gray responded yes. william porter communicated that allegedly to the driver of the van and they did not go to the hospital at that point. secondly, according to the probable cause statement, freddie gray is on the floor of
william porter, the first one to go on trial. that s because prosecutors believe a statement he made is critical to other prosecution, so they want to try to gain that connection with him first. when he arriveses, about halfway during that van ride, he asks freddie gray if he needs medical attention. gray responds that he does. that was communicated. at that point they did not take him to a hospital. laura, because this is a case that s gotten so much publicity, in fact, some of the jurors may have been impacted by it, the curfew, the protests that went on after the death of freddie gray, what happens if they can t find an impartial jury with this pool that they have right now? what would happen then? one thing they could do is move it out of baltimore city. jean is absolutely correct, the judge has been adamant about wanting to do that because they want baltimore residents to have afternoon opportunity to be the peer for this jury. but also an option is to have the jury trial go a
based on the fact they thought they had probable cause and didn t. there s an issue about whether that knife was legal. if you do that, what will happen, you can sue the police department but if you do that what happens is police officers will stop making arrests. she s criminalizing bad decisions. in her opinion, bad decisions by the cops. judge alex and yourself there. that was a mistake. let s end it on a happy note of agreement. none of the lawyers believe she should be disqualified. there s a question of whether they can get a fair trial in baltimore. that s a separate question of whether there needs to be a change of venue here and mark furman is moments away on that. a big question in this case is about a man who could prove to be the key witness. the only person who shared the van ride with freddie gray to the police station. and the question now is whether this man will help or hurt the prosecution s case.
