Chief Judicial Magistrate Fayaz Ahmad Qureshi granted interim bail after a police report revealed that charges under UAPA were dropped and instead, the offence under section 153-A of the IPC was incorporated.
Additional Sessions Judge (ASJ) Hardeep Kaur passed the order after the Delhi Police told the Court that police would not require the custody of the two accused and that they could be sent to judicial custody.
The accused petitioner told Gauhati High Court that he was being picked up every year, around Independence Day and Republic Day, by the police who also took his photos in public view, thereby tarnishing his reputation.
As per witnesses, Bhatkal committed different terrorist activities to create terror and destabilize the society as a whole, the court said in its order.
