âInclusionary zoning has been accepted by the courts repeatedly in terms of a requirement to have a certain percentage of new construction . considered to be affordable,â he said.
The review came after Mayor Steve Noble signed an executive order that would require all developers seeking approval for plans of more than five apartments to make 10 percent of them affordable.
In Kingston, executive orders are in effect for 30 days, at which time they can be renewed for another 30 days, Summer Smith, director of the city communications and community engagement, said at the time.
