HOUSTON A recent appeals court ruling that provided immunity for an FBI agent who fatally shot a kidnapped Houston area man during a botched rescue attempt is being legally challenged, the man’s family and attorney said Tuesday.
In March, the 5th U.S. Circuit Court of Appeals overturned a federal judge’s ruling that had denied the unidentified agent’s claim he could not be sued due to qualified immunity, which offers police officers and other officials protection from civil lawsuits seeking money.

HOUSTON – The family of a kidnapping victim killed by an agent in a botched 2018 FBI raid is appealing an appeals court decision that the agent who fired the shot will be able to get qualified immunity.
At the time of the incident, former Houston police Chief Art Acevedo said two agents were breaching a window of a darkened room at the back of the home where Valladares was being held against his will while another team entered the front of the home. The tool being used to break the window fell inside the home, and one of the agents used the front of his rifle to continue the breach, Acevedo said. Acevedo said Valladares grabbed the agent’s rifle and began pulling it. The agent felt that he was about to lose the gun and fired, hitting Valladares, Acevedo said. Vallardes late

Ulises Valladares was kidnapped and held hostage in Houston in January 2018. The FBI was on a mission to save him. Instead, an agent ended up shooting and killing him. On Wednesday his mother held a press conference begging for answers.
