Strictly Legal: Employee can t establish defamation claim in workplace investigation Jack Greiner, Cincinnati Enquirer A recent Massachusetts appellate court illustrates how difficult it is for an employee to make a defamation claim based on comments made by fellow employees in a workplace investigation.  In most cases, those statements are privileged, as well they should be. The Massachusetts case arose when a woman named Diane Lawless got into an altercation with one of her subordinates.  Her employer, the Town of Freetown, initiated an investigation into the incident and solicited statements from several employees.  One of those employees, Cheryl Estrella, who had formerly reported to Lawless, submitted a detailed, six-page e-mail setting out her observations and concerns with Ms. Lawless.  Included in the e-mail were Estrella’s recounting that Lawless spent an inordinate amount of time online shopping and socializing on the phone.  She described Lawles
