La Ley de Amparo, Exhibición Personal y de Constitucionalidad (LAEPC) dispone que la designación de magistrados titulares y suplentes de la CC por parte del Consejo Superior Universitario (CSU) de la Usac, cuyos miembros son empleados públicos, se hará por mayoría absoluta de votos de los miembros presentes en el acto electoral en votación secreta.
De esa cuenta, la votación en el seno del CSU de la Usac para designar magistrados de la CC debe ser secreta, extremo que garantiza la ausencia de presiones, así como la absoluta independencia del votante. El voto público, por el contrario, puede condicionar al votante, así como exponerlo a represalias.
