charges. this is something we see in other cases as well where a hate crime charge is not as high up as a priority or severity of a charge as say a first degree murder charge. you heard the district attorney say that may not be included in their charges because there are more severe charges at hand. but it does mean something to the community, to the families when hate crimes are investigated as such. but that s something we will have to see how it plays out. nadia, thank you for that great reporting. now to give us more insight, former detective and law enforcement consultant tom verny. thank you for joining us. this is a 22-year-old suspect that continued to move through the club during the shooting. what does that tell you? good morning, paula. my sincere condolences to the family and friends of those killed. and my thoughts with those injured hoping they ll make a full recovery. you know, look, it s another sad
walking on egg shells. that s according to the police union after a police detective is pistol whipped unconscious with his own gun following a traffic stop. the officer hesitated to use his weapon because of the national attention that s been brought on police shootings. cnn has spoken to the officer high pressu. he said he suffered a con conscious and needed more than a dozen staples. the man was arrested and charged with attempt murder. several bystanders took pictures of the officer on the ground instead of helping him. even some of the online reaction appeared to show delight in seeing the officer injured. joining me now to discuss is former nypd detective tom verny. what do you make of what the union president said, that the officer hesitated because of the national attention on police
have used whatever tool available to him. if that happened to be his firearm then so be it. if that would have been me where i m by myself and being attacked then i would not have had a problem using my firearm. there s an old saying i would rather be judged by 12 than carried by six. that applies perfectly in this instance here. do your job the way you were trained to do as long as you re doing it lawfully and doing it along the rules and regulations of whatever guides that your department is using then you ll be exonerated in what you re doing. that s the important part. do your job right and everything will be okay. i think that s the big part of this national conversation that s happening right now. tom, thank you very much for coming in. i appreciate it. coming up for us, a historic moment in cuba. for the first time in more than 50 years the american flag is flying once again at the u.s. embassy there.
that s all white, then people are going to continue to have questions. if you just have local law enforcement officials doing the investigation without some oversight from the fbi or the justice department, people are going to have questions. and the district attorney, the county judge, the lieutenant governor of the state of texas, sylvester turner, the chair of the black caucus, have all agreed we need to make certain that we have as much transparency and as many agencies involved in this investigation as possible. state senator royce west, thank you so much for your time, sir. my pleasure. let s continue this discussion. there s a lot to delve into. i want to bring in tom verny as well as charles blow and legal analyst paul callan. three important aspects to get into what happened here. we heard the state senator talking, there are a lot of questions still. let s start first with the new video out, the arrest video. paul, from your perspective,
handcuffed and i think that s where the problem is going to be for the trooper. tom, there s a lot of protocol questions here. this guy seems like he s in some sort of trouble. the texas department of public safety put him on administrative leave. and they said protocol was not followed. what s the big thing that stands out to you? is it how quickly he went from saying, put the cigarette out to, get out of the car? another thing raising a lot of eyebrows is how quickly he says, i ll light you up, i m going to tase you. this is not your textbook car stop. that s one of the most dangerous jobs the police can do. there s no routine traffic stop. there s not. there s a series of unknowns. you don t know if that person is wanted. you re out in the middle of the road. there s risk of being hit by a car put yourself in his shoes as much as you can. what should have happened? again, it seems clear the officer was agitated and also it s clear she was agitated.
