A traffic commissioner has refused an application by an operator wanting to run HGVs out of a Peterborough base after failing to convince him it had satisfactory arrangements to maintain vehicles. Sole trader Samuel Githinji appeared before Eastern region TC Richard Turfitt via video link after applying for a licence to run two lorries. Githinji nominated himself to act as transport manager, although the TC noted he was previously transport manager on a licence which was revoked in 2004.
In a written decision, Turfitt said the financial evidence provided by Githinji was not sufficient to meet the statutory test and was relying in part on a personal credit card belonging to the applicant’s daughter-in-law.
This 18-tonner has a 20ft dropside body with a remote control crane and Kinshoffer rotator.
It has covered just 240,000km since first being registered in 2012.

TC lays waste to Midlands haulier

A director of a Lichfield waste haulage business has been disqualified for three years after presiding over “a disturbingly non-compliant operation”. Nick Denton, West Midlands TC, said Jones Waste Services had shown an abject neglect of its legal duty to keep vehicles fit and serviceable and had endangered the safety of other road users.
The company appeared before the TC following a maintenance investigation by the DVSA, which found a poor MOT pass rate, an ineffective driver defect reporting system and excessive gaps between safety inspections. A follow-up investigation found the situation has deteriorated further and that drivers were clearly failing to conduct effective walk-round checks of their vehicles.
