presumably with mueller and will not step on his investigation. but this is an outgrowth. the fact they re following up on the tax counts as well with michael cohen is a factor also. and, in fact, in virginia, they can file open tax counts on manafort. he talks about pardoning manafort but there could be state counts as well. yes, the breadth of this is really extraordinary. i want to bring in jeff horowitz, a reporter for the associated press, and you broke this incredible story about david pecker keeping documents in a safe. what do we know about what exactly was in there? we know this was sort of where all the catch and kill documents were kept not just on donald trump necessarily? yes, exactly. so not just on donald trump. definitely there were things related to trump. and, you know, the karen mcdougal situation. there were other things as well. it s not clear we know what all of those things are. the a.p. reported one to a
with eight counts of guilty but ten counts in which the jury didn t come to a verdict. joining us now is barbara mcquade, former u.s. attorney for the eastern district of michigan. thank you very much for being with us tonight. i know you have been like white on rice on this trial from the beginning. i m so happy to talk to you about it tonight. oh, thanks. i m glad to be here. mistrial on ten counts. is there anything that you can tell about which verdict which counts the jury did give a verdict on versus the ones on which they couldn t come to con sensus that tells you about how the case against manafort went and was received by that jury. it s hard to know exactly what was going on. we know they convicted on all of the tax counts and so that suggests that you know, that was one where they were all in agreement and didn t have a problem with. they did not convict on most of the f bar accounts. this is the failure to identify foreign bank accounts. only one of those counts. an

by the way, there s nothing unusual about this, at all. especially in a big indictment with a lot of counts. if the jury comes to the conclusion of 17 out of 18, normally the court will say, all right, i ll take the verdict and the 1 count they haven t agreed on they re hung on that count, the prosecutor might have the right to retrial the defendant on that count if that s a critical, very, very important count but i ve been looking through the counts and you can sever all of them from each other. for instance, the tax counts have to do with tax returns signed in different years. so maybe they have a problem with one year but they don t have a problem with the indictments on the other four years. some of the bank fraud counts deal with different banks. and different loans. so it could just be one loan that they thought that was inadequate proof on and can t reach a condition collusion and all of the others they can. so if you have 17 counts where there s a verdict is that the funct
the five guilty counts. separately, the michael cohen situation in manhattan. of course, the president s personal lawyer who had pled guilty to campaign violations and fraud, all of which could land him in the slammer for up to five years. robert, you are hearing all of this. more in the manafort situation. on the manafort situation, we have yet to hear about the remaining eight counts. it looks like there are five guilty verdicts. the other three are likely to be guilty as well. we will find out. he was found guilty as in regard to the tax counts. you file your own tax returns, you know what you file. you signed them. i suspect that the jury probably did have problems with some things related to the bank fraud charges. neil: awaiting financial decisions. a little bit more complicate it.
