COLLEGE PARK, Md. (AP) The last federal inmate facing execution before President Donald Trump leaves office was sentenced to death for the killings of three women in a Maryland wildlife refuge, a crime that led to a life sentence for the man who fired the fatal shots.
Dustin Higgs, 48, who is scheduled to be executed on Friday at the federal prison in Terre Haute, Indiana, says nobody alleges he pulled the trigger. His lawyers have argued it is “arbitrary and inequitable” to execute Higgs while Willis Haynes, the man who fatally shot the women in 1996, was spared a death sentence.

The tone of his voice was calm but defiant as he said his last words, “I’d like to say I am an innocent man,” he said, mentioning the three women by name. “I did not order the murders,” the report said. Higgs’ victims were Tamika Black, 19; Tanji Jackson, 21; and Mishann Chinn, 23. Higgs’ execution went forward despite his attorney, Shawn Nolan’s appeal to delay the proceeding because of Higgs’ Covid-19 diagnosis. Nolan also argued that Higgs was unfairly sentenced, since the actual gunman is serving a life sentence. Higgs’ execution was initially scheduled for the 92nd birthday of Rev. Martin Luther King Jr.

TERRE HAUTE, Ind. (Reuters) – On Thursday evening, Dustin Higgs, 48, waited in a cell on death row at the federal prison in Terre Haute, Indiana, his scheduled execution less than 24 hours away.
A five-minute drive down the road, members of his legal team sat around a laminated plastic table in the lobby of a no-frills hotel off the interstate. Federal Defender Shawn Nolan sipped beer as he waited for his colleagues in Philadelphia to patch together the four or five points needed for a last-ditch court filing aimed at delaying Higgs’ execution by lethal injection.
