A lawsuit for infliction of emotional distress was filed against 80-year-old Rubin Flores on Thursday, alleging he helped move the remains of Kristin Smart from under his Arroyo Grande home in early 2020.

In the lawsuit, Smart family attorney James Murphy accuses Rubin Flores, his ex-wife Susan Flores and her boyfriend Mike McConville of moving the body in early Feb. 2020, just days after investigators searched Rubin Flores’ home. They “worked through the night, under the cover of darkness, to remove the remains of Kristin Smart to avoid having those remains at 710 White Court in the event of an additional search of the property,” according to the lawsuit.

The parents of missing California college student Kristin Smart on Thursday sued the father of the man charged with killing their daughter nearly 25 years ago. The lawsuit filed in San Luis Obispo County Superior Court said Smart s body was buried in Ruben Flores s backyard and he moved the body under cover of darkness to another location a few days after investigators searched his property in February 2020.

Ruben Flores released from jail after having bail amount reduced
SAN LUIS OBISPO, Calif. - The father of the man charged in the murder of Kristin Smart had his bail amount reduced Wednesday and was released from jail that night.
Ruben Flores, the father of Paul Flores, appeared in San Luis Obispo Superior Court via video Wednesday afternoon. Flores, who is charged with being an accessory to Smart s murder, had his bail amount reduced from $250,000 to $50,000.
Ruben Flores was released on bail at around 11 p.m. Wednesday. His ex-wife, Susan Flores, showed up to the San Luis Obispo County Jail about an hour before.
