AG Chambers wants Johor MP s leave application to challenge Parliament s suspension to be heard in KL

KUALA LUMPUR (Feb 8): The hearing of PKR lawmaker Hassan Karim’s leave application to initiate judicial review proceedings to challenge the suspension of Parliament did not proceed at the Johor Bahru High Court today, after the Attorney-General’s Chambers (AGC) applied to transfer the hearing to Kuala Lumpur. This was supposed to be the first leave hearing after several individuals filed legal challenges against the decision to suspend Parliament, following the proclamation of Emergency on Jan 11. Hassan had filed the judicial review at the Johor Bahru court and named Prime Minister Tan Sri Muhyiddin Yassin and the government as respondents. He is seeking several declarations including that Section 14 of the Emergency (Essential Powers) Ordinance 2021 is unconstitutional and inconsistent with Articles 44, 150(3), 150(5) of the Federal Constitution. 

AAX wants to set aside BOC Aviation foreign judgement demanding the carrier pay US$23 3m

KUALA LUMPUR (Dec 30): AirAsia X Bhd (AAX) and AAX Leasing Two Ltd has applied to set aside the foreign judgement obtained by BOC Aviation Ltd in the High Court of Justice, Business and Property Courts of England and Wales in November, which is enforced in the Malaysian courts here on Dec 7. The matter came up for case management before High Court deputy registrar Norazlin Othman today. She gave several directions for parties to file affidavits and fixed April 12 for the probable hearing of AAX and the other company s application. BOC Aviation, which is represented by counsel Kwan Will Sen of Messrs Lim Chee Wee Partnership, is objecting to AAX s application to set aside the enforced judgement on the grounds that there is no restraining order obtained by the airline, as it sought a scheme hearing at another High Court.
