In-depth guidance has been released in Scotland for farmers who wish to sell their secure tenancies to their landlord or a new entrant.
The new legislation was introduced as part of the Land Reform (Scotland) Act 2016 in February 2021. It applies to tenancies under the Agricultural Holdings (Scotland) Act 1991, of which there are about 4,000.
The sale price will be determined by an independent valuer using a prescribed formula.

A request to relinquish a tenancy prompts a sequence of time-limited procedures, a valuation process (the cost of which is to be covered by the tenant), and potential bills for professional advice.

Agriculture and environment departments across the devolved administrations have released key dates to help farmers avoid costly cross-compliance rule breaches in 2021.
The rules apply to all Basic Payment Scheme (BPS) claimants and are made up of statutory management requirements (SMRs) and standards for Good Agricultural and Environmental Conditions (GAECs).
Infringements, including those made accidentally, result in penalties applied to farm support payments.
These penalties are imposed by the Rural Payments Agency and range from a 1% reduction in BPS for every area breached, to 100% of the BPS in cases of severe, persistent and intentional failures.
