女子疫情居家办公遇害未定工伤,法院这样判 5034 　　7月12日，妹妹柴媛死亡一年后，黑龙江女子柴芳终于收到了法院的行政判决书。法院认为，柴媛由于处于居家办公的工作环境而受到了案涉暴力伤害，其死亡情形应认定为工伤。 　　事发是在2020年6月18日。 　　柴芳认为，妹妹是在工作期间遇害，应认定为工伤。据其提供的聊天记录显示，嫌疑人进入柴媛屋内的几分钟前，她才将一份周工作总结发送至部门微信群中。 　　大庆市人力资源和社会保障局及黑龙江省人力资源和社会保障厅则认为，柴媛疫情期间居家办公，可以视为工作时间和工作场所的延伸，但柴媛被害与其履行工作职责没有因果关系，故不认定工伤。 　　最终法院判令大庆市人力资源和社会保障局重新作出工伤认定决定。 大庆市人才引进通知单。受访者供图
