The federal court will soon rule whether restrictions imposed by the New South Wales government preventing the creation of a commercial container terminal in Newcastle are legitimate.
Established in 1799 - the Port of Newcastle is the largest thermal coal terminal in the world and generates around $26 billion for the economy each year.
The world’s shift to cleaner energy means it needs to diversify but the privatisation of state assets almost a decade ago is blocking the port from creating a commercially viable container terminal.
In 2013 the state sold Port Botany and Port Kembla for billions of dollars on the condition container traffic through Newcastle would be restricted for 50 years.
This meant the government would have to compensate the NSW Ports Consortium if container traffic at Newcastle went above a cap.
However, the Australian Competition and Consumer Commission has claimed it was an illegal deal which had “an anti-competitive purpose and effect”.
