Need for greater, in-depth study of Constitution, says Supreme Court judge

Justice Kaul was speaking at the release of a book, Rethinking Palkhivala: Centenary Commemorative Volume . He said that legal innovations by young professionals would take the society ahead on development path. There is a need for greater and in-depth study of the Constitution with a view to adhere (to) its norms for achieving the aspirations and dreams of its makers, he said, while exhorting the youth to follow the contribution of Palkhivala. He added that the challenges overcome by role models in their career can serve as useful case studies. The book edited by Maj Gen (retired) Nilendra Kumar carries speeches at various events during the year-long Nani Palkhivala Birth Centenary Celebrations last year.

NEW DELHI: To give two young convicts a chance to rebuild their lives, the Supreme Court took resort to the Probation of Offenders Act to side-step the mandate under section 397 of the Indian Penal Code for award of a sentence not less than seven years to those convicted for armed robbery. The trial court had in 2005 convicted the youngsters under Section 397 for attacking a taxi driver with sharp edged weapons, inflicting serious injuries and robbing his vehicle in 2003. The trial court refused to relax the mandatory minimum seven years sentence even though the convicts had invoked the PO Act. The High Court had rejected their appeals in October 2019.
