beyond the bounds of the law. but i have to say as the competing factions articulated their decisions from the bench this morning, it was clear that the liberal dissenters think this majority is actually undercutting the reputation of the court in the public eye just because of what it s doing. justice kagen said in a very rare dissent from the bench today that the kind of power that s being amassed here and being taken away from both the legislative branch and the executive branch is being taken by the court itself. and who s running the court itself but these six conservatives led by chief justice john roberts. in some ways chief justice roberts has seemed to want to play the role of making sure the court doesn t go too far, right? but he did not do that in the two cases we saw today. that s right. we all remember last year this week in june when he broke off from am majority that wanted to completely overturn abortion
basically step in and try to erase billions of dollars of debt. he needs congressional authority to do that, and that is where the supreme court agreed. the court has shown enormous deference to congress, right? oftentimes in its decisions it says that should be a congressional responsibility or it s a state legislature responsibility. we saw that for instance on the dobbs case. in this case, though, i heard other folks interpret the law, the heroes act the decision was based on was as congress wrote the law and gave the president this authority. how do you understand how the court defines congress role here and does it stand up? that s what justice kagen wrote. she said the court is in here and it s ignoring what the court has said. but this conservative court at times has been very skeptical of administrative agencies. they say, look, separation of powers. they are not accountable to the people, and they believe this
as it s not this strict quota. at issue are plans for the university of north carolina and harvard and these schools argue they want to take race into consideration so that they can increase diversity on campus. they say that that leads to a better learning environment and at oral arguments elena kagen said these schools are very often the pipelines to leadership in society. but the challenges, they come from a conservative group here, and it says basically that these plans violate equal protection principles as well as federal law that bars you from race discrimination. they say that the plans actually thwart their goal of a color blind society. so the most important thing to remember here is almost just a year ago the court made that move to overturn precedent in area of abortion. now the big question is whether this conservative court that is bolstered by three of president

nervous about it or get attacked by it. it gets sucked up into these first amendment arguments, which it s not necessarily related. so it becomes a mess. and if they miss one thing, and they often do, it can result in a problem. and so, again, these are a very small group of people making these decisions. and even though they do have rules, they re not enforced. and it s sort of like having no stop signs all over a city because people just blow them all the time. so, sarah, you ve got to give cred tat to the u.s. supreme court knowing their limitation at the very least and justice kagen saying she didn t put it this way, but basically we barely know how to use a mouse. do you think congress is up to speed when it comes to being able to revise or create new legislation? that s a good question. i think congress has a long way to go in figuring out what to do. you have very progressive folks saying we should abolish section 230 altogether, but the problem is, jake, there s no altern
