A single judge bench of the High Court directed a journalist to take down social media posts which it found to be prima facie defamatory in a suit by a businessman.
One person alone cannot be blamed and charged for rape when a relationship between two adults turn sour and does not culminate in marriage, the Bombay High Court recent held.
After reserving its order, the Bombay HC has finally quashed the complaint of a journalist alleging criminal intimidation. Journalist Ashok Pandey had lodged an FIR in 2019.
The court also appreciated the ‘ardous task’ of the trial judge to extract the minor victim’s version of the act where the child stated that the accused had been a ‘bad uncle’.
Single-judge Justice Bharati Dangre said that there was no sexual intent on part of the appellant and that his utterance definitely indicate that he had seen her as a child and hence, he said that she has grown up.
