Even the prosecution should be able to approach the appellate court after the expiry of 90 days on sufficient cause being shown, as closing the doors can lead to serious consequences, the Court said.
In a significant judgement, the Bombay High Court has held that an appeal against a trial court’s order can be entertained by the appellate court even after the lapse of statutory period of 90 days.
"The authorities must understand we are not against them. We will not permit this on our watch. Much of this has happened due to courts," said Justices Gautam Patel and Kamal Khata.
