A bench of CJI DY Chandrachud and Justices JB Pardiwala and Manoj Misra observed that the activities were being carried out in the absence of an environmental clearance, which was in breach of the EIA Notification.
CJI Chandrachud called the three-year deadline for criminal trials in the new criminal laws "a breath of fresh air" while SG Mehta said that the provision for staggered custody was anti-criminal, not anti-people.
CJI DY Chandrachud was speaking at a full-court reference held at the Supreme Court today in honour of late veteran lawyer Fali Nariman who passed away on February 21, 2024.
"The journey of fundamental rights has been a constant struggle, a constant fight, a constant conflict between the majoritarian government and the Supreme Court of India," said Tushar Mehta, the Solicitor General of India (SG).
