agents opened fire shooting the man in the head. trace gallagher has more details. reporter: you know, san ysidro is what separates san diego from the crime-ridden city of tijuana. these three suspects made their way through a sewage ditch and up and over the fence where they were met by the border patrol. they arrested one of the suspects, the other two fled back over the fence. one of them began throwing rocks and a piece of wood with nails stick being out of it that did strike one of the border patrol agents, the other agent opened fire striking and killing the man and now you have the mexican government, immigration rights activists, the aclu all saying this shooting was unjustified. the aclu saying, and i m quoting, we are still waiting to hear the facts of this is dent but regardless our law enforcement agencies need to find new ways to handle such situations and avoid the unnecessary taking of human life. shooting someone who is throwing
