allegations of wrongdoing. if you think about this, a president wrote a note on presidential letterhead, a blackmail letter. they couldn t decline that nobody should know about that criminal conduct. executive privilege is not meant to cover that. so i don t think he s going to make any grounds with the court making an argument. lawsuits by their nature are difficult for litigants. they are not the most pleasant things. he s saying it s harassment for them to investigate. such is the nature of checks and balances. i think he ll find an unfriendly bench. this is an historic case and it could have lasting consequences, setting precedent moving forward. it sounds like you think the appeals court will rule against the former president. i really do. they ve raised an issue of standing. the court on its own has brought forth this question asking parties to be available to address whether or not the
scheme of things very important except to me, what it does do is help prosecutors hopefully establish intent and state of mind because we know that the behavior that s being looked into, tax fraud, tax evasion, et cetera has been going on for decades. so we re looking at setting precedent, and we re looking at state of mind and intent. and that s incredibly important when we re talking about criminal cases. and you said many times that whatever was happening, he would have known because control is everything. mary trump, thank you for being with us tonight. good luck going forward. thank you. all right. now, there is another window into potential distress for the former president, and that is the ongoing criminal investigation into rudy giuliani because of his dealings with ukraine. cnn has just obtained exclusive audio that exposes how trump s

hearings they don t go well. and we saw that dramatically with the mueller hearings. you look at what happened today, the witnesses similarly, poorly chosen. you have three witnesses per democrats, elizabeth warren donor and upset about hatred for donald trump that she says she can t walk on the sidewalk in front of a trump property. you had someone who said they didn t need evidence of crime for impeachment which is technically true but not the best talking point. and then you had a guy, brett kavanaugh and dianne feinstein. these are not the type of witnesses you selective trying to convince people that you are operating in a nonpartisan evenhanded manner and as the day wore on, look like how partisan they were. bret: both sides pointed to setting precedent out of what comes out of the impeachment hearings. take a listen. if there is no action and if congress concludes, they will give a pass to the president
