just everyone. they know exactly what dots need to be connected, and they go out and they get the documents that they need. reporter: what is the problem with these documents? attorney allison albert said it was done to her client, diana and david jones, facing foreclosure on the home they ve lived in for 20 years. they have two documents executed within a week of filing with different information on them. different dates, different entities. reporter: their servicer would not comment, citing pending litigation. technicalities and mistakes. but diana says it s just wrong. in all honesty, you re taking away a person s home. there shouldn t be any room for mistakes not when you re putting a family on the street. reporter: foreclosure auditors say these mistakes are adding up wrongful foreclosures. the major banks declined to be interviewed. they hold congress that questionable practices were isolated and had been stopped.
yes. and i was contacting them over and over and over again and making arrangements and trying to everything we could to get caught up. reporter: diana says she wired monthly payment to the servicer and it was rejected. would not talk us to once the paper was served. reporter: allison albert is the loan s legal aid lawyer. the loans fell a little bit behind on their mortgage payments and rather than the bank working with them, the bank went right ahead and filed a foreclosure suit. what happened to us is no fault of our own. we didn t plan my husband to get sick. we didn t plan to lose that income. you shouldn t lose your home for that. reporter: lones family has sold many of their belongings, removed light bulbs to save electricity. they couldn t afford to fix their heating system and now use this propane canister for warmth. they have put more than $8,000 into an escrow account to bringing their mortgage current but the servicer says they have to pay off the entire loa
quarters. listen, the story you re describing, their experience, is very common. i just met a group of families out in oregon. many of them were talked to by their servicer who said, hey, why don t you try this program and they hadn t yet failed to make any payments. so they were the program was suggested. they were told they were good candidates. and then fees started to pile up. servicer stoorts make a lot of money on fees that they don t make when a family makes their payments. there isn t the full commitment to actually do the modification that would assist the family in the end. i think we have to fully explore this because it does seem like something has gone terribly awry. did you feel you were dealt with and directed in an honest manner? no, i don t. i didn t at all. you know, to me it was a scam from the beginning. looking back at it now, i just it was just a real
