KNBN NewsCenter1 February 18, 2021 ELLSWORTH AIR FORCE BASE, S.D. Senior Airman James T. Cunningham has been found guilty of murder, after an infant he assaulted in March 2020 died nine days later. Cunningham was first charged with felony aggravated child abuse, which was upgraded to murder after the infants death. The court-martial will now enter the sentencing phase. The infant was found shortly after 5:30 p.m. on Tuesday, March 3, 2020, when Rapid City Police were dispatched for a report of an unresponsive infant. Medical units arrived and transported the infant to the hospital for treatment of life-threatening injuries. In the investigation, police found that the injuries were a result of abuse. The baby was later flown to Sioux Falls for treatment, but died nine days later.

Cunningham ended late Feb. 18, with the military judge sentencing SrA Cunningham to serve 18 years in a military prison, be reduced to the grade of Airman Basic, forfeit all pay and allowances, and to be discharged from the United States Air Force with a Dishonorable Discharge. Photo Courtesy Pennington County Jail Cunningham was charged on Aug. 4, 2020, with one count of violating Article 118 of the Uniform Code of Military Justice for murder. Following a pre-trial investigative hearing on Aug. 13, 2020, the charge was referred to trial by general court-martial.
