In the early afternoon of January 6, 2021, a mob of Trump supporters laid siege to the United States Capitol, where lawmakers had gathered for a joint session to count Electoral College votes.
Charges that Trump had incited the attack quickly emerged. But did he do so? And what is incitement, anyway? We think of human beings as free agents. If someone encourages someone else to break the law, and they’re foolish enough to do it, then we generally believe that we should punish the bad actor, not the person who just did the talking.
