I want to reemphasize one of the main points he mentioned in his testimony that it is at heart a civil rights law. Federal government has an Important Role to play ensuring equity for our children and while states have discretion to determine thousand success is measured the federal government sets the standard for success. Its especially true in underprivileged groups. So states have the discretion to create and define the use for consistent under performing.
