Frasheri's says Frasheri was merely flailing his arms, a symptom of brain injury. Though he was unconscious, he ended up under arrest and shackled to an ICU bed before he died.

But no cops showed the second day of the wake when a shooter or shooters in an SUV carrying four men opened fire on the mourners, mortally wounding Whitfield. The NYPD had a duty to provide protection at the wake, the lawsuit says.
