the federal authorities contacted the sheriff. let me just see if i can walk through this. sure. so then when he was turned over, he went to the sheriff, the sheriff then took him to court because at that point the sheriff you have got this outstanding warrant and when he gets to court with him or the sheriff s deputies, whoever brought him over, the prosecutor said we are not going to charge him so there is now at that point nothing in the state system it to hold him other than this detainer from ice which was neither a warrant or a bench warrant from a court right? right. what happened is after the case was dismissed he was actually held in the county jail for another two weeks. by what authority? under what authority? good question. i mean, there was no authority. when you have an outside warrant, you have to be picked up in five days or released. that didn t happen. and the point that has been made is that the sheriff says well, you know, under san francisco s law i w
convicted of entering the country five times and he actually served 15 years. the last sentence that he served was a four-year sentence. that was the sentence which preceded his being brought to san francisco. and he was brought to san francisco on a warrant that was 20 years old. and that case was dismissed. he was released in san francisco. and it has been reported that he had all these criminal contacts. he has five convictions for illegally entering the country. as i said he served 15 years for that and he has a couple of minor drug convictions from oregon. nothing here in california or san francisco. well, i assume you have seen the finger pointing between the sheriff and ice. maybe you can explain this to me. when he was turned over from the feds to the sheriff he had completed his time with the federal system; is that right? all the crimes he had been convicted of. he was done with the federal system at that point right? right.
it doesn t say anything about the transfer which is what a community is supposed to do if they have a detainer but not a warrant. they are looking for a heads had up. a notification except in the rarest of cases. if they have gotten the heads up the sheriff wouldn t have had to held them those 111 extra days. they wouldn t have had to hold them for a second. is that practical? these jails are so full of people. remember every single person that comes in from the feds supposed to remember that unpractical and unreasonable. the fact that the secretary of homeland security is coming up with programs and trying to patch things together and ice is trying to patch things together as is the sheriff shows the utter insanity in this city that they haven t done anything. i agree with you there. it s a definite patchwork. ice and dhs has no choice but you to try to come to the table and figure out a way can we come to some agreement on some certain individuals? i do have to correct one thin
