Court strikes out BATN s suit against FCCPC - Daily Post Nigeria

Daily Post Nigeria Published The Federal High Court sitting in Lagos, on Monday, struck out a suit filed by the British American Tobacco Nigeria (BATN), against the Federal Competition and Consumer Protection Commission (FCCPC). DAILY POST reports that BATN had asked the court to prevent FCCPC from investigating it for anti-consumer protection, public health and anti-competition violations that the Commission was investigating. Justice Rilwan Aikawa, held that the case was premature and lacking in merit. Aikawa said that there was no basis or urgency for the filing of the action after the Pre-Action Notice, which according to him, remains the fundamental provision of the law.

Robert Egbe THE Federal High Court in Lagos on Monday refused an oral application by an oil firm, Seplat Petroleum Development Company, for access to its accounts and offices which were shut following a court order. Justice Rilwan Aikawa declined the prayer following opposition to the application by Access Bank through its counsel, Mr Kunle Ogunba (SAN). Access Bank, the plaintiff/respondent in the suit, secured the ex-parte mareva injunction from the court to shut Seplat’s premises and freeze its accounts in Nigeria and abroad, following an outstanding loan of about $85.8million. Justice Aikawa granted the interim preservative reliefs to preserve the res (subject matter of suit), pending the hearing and final determination of the motion on notice filed in the suit.
