Volusia County Animal Control officers transported the dog for treatment and the animal was up and walking shortly after the incident, Gant said.
Nelson claimed he was defending himself from the dog but sheriff’s investigators obtained video surveillance that proved he was not, Gant said.
The attack on the dog occurred on July 9 in the backyard of 1931 Jungle Road near New Smyrna Beach. The owner of the dog reported that Nelson, who was in the backyard of the property, attacked her dog after she let it outside, Gant said.
The owner conceded that the dog doesn’t like Nelson due to past encounters, but that the violent machete attack was unprovoked, Gant said.

Volusia County Sheriff s deputies were called to a home at the 1900 block of Jungle Road on July 9. The dog s owner told investigators that Richard K. Nelson, 46, attacked her dog with a machete unprovoked when she let the dog out in the backyard. Nelson told authorities that the dog attacked him and was defending himself.The following day, Volusia County animal control provided officials with surveillance video that disproved Nelson s statement. Deputies said the video shows the dog running in the yard and as it passes Nelson it growled. Nelson then ran after the dog, threw something at it and then start
