Hungary opposes the EU s migration action plan: Europe s Borders Must be Protected

The Court of Justice of the European Union, the EU s top court, has ruled that Hungary violated EU law when it prevented illegal immigrants from seeking asylum. The ruling paves the way for the European Commission, the EU s powerful administrative arm, to impose financial penalties over Hungary s restrictive immigration policies. The Hungarian government has vowed that it will not bow to pressure to jump aboard the EU s multicultural bandwagon.
In its December 17 ruling, the court, informally known as European Court of Justice (ECJ) accused the Hungarian government of corralling migrants into so-called transit zones and of limiting their ability to apply for asylum. The court also found that Hungary did not allow asylum seekers to leave detention while their cases were being considered and offered no special protection to children and the vulnerable.

The European Court of Justice (ECJ) ruled Thursday that Hungary failed to fulfill its obligations under EU law after adopting legislation that restricts international protection offered to asylum seekers.
The ruling comes after Hungary adopted legislation in 2015 that created transit zones at the Serbian-Hungarian border to apply asylum procedures and created the concept of a “crisis situation caused by mass immigration” in which derogation from general rules would be allowed.
The European Commission subsequently brought an action against Hungary for failure to fulfill its EU obligations by disregarding “the substantive and procedural safeguards provided for” in EU law, restricting access to international protection provided for asylum seekers, and establishing detention zones that asylum seekers could be forcibly deported to.

EU Court: Hungary Failing to Fulfil Obligation to Protect Asylum-seekers
Hungary has failed to fulfil its obligation under EU law to grant international protection to illegal migrants from third countries, the Court of Justice of the European Union in Luxembourg ruled on Thursday.
The European Commission launched an infringement procedure against Hungary over the transit zones established along its southern border and its changes to refugee procedures
in 2015. According to the EC, Hungary failed to provide guarantees against holding asylum-seekers in detention unlawfully in the transit zones as well as guarantees concerning procedures under which illegal migrants were expelled.
