2021年07月09日作者：张武丁王平平张赞宁来源：中国环境报　　第二轮第三批中央生态环境保护督察期间，有群众举报：某村边存在两处养牛场，粪便露天堆放，污水漫流、臭气熏天。经查，一处存栏25头，一处存栏38头，均为规模以下养殖场。前者建有沼气池，但未正常使用；后者未建粪便处理设施。遂督促整改，两处养殖场很快将粪便还田，并立即建设化粪池等设施，消除污染、加强管理。　　目前，各部生态环境保护法律法规规定的罚则几乎都是指向规模养殖，那么，规模以下畜禽养殖场是否可以处罚呢？　　如《环境保护法》第四十九条第三款第一句规定，“畜禽养殖场、养殖小区、定点屠宰企业等的选址、建设和管理应当符合有关法律法规规定”；《水污染防治法》第五十六条第二款规定，“畜禽养殖场、养殖小区应当保证其畜禽
